In Discrimination Legal Woes News RaceWars SadNews Say what?

Federal Court Says It’s Not Racist to Ban Locs at Work

Federal appeals court ruled that employers who ban dreadlocks in the workplace are not engaging in racial discrimination, according to the Huffington Post.

It's legal? well, yes according to the 11th U.S. Circuit Court of Appeals voted 3-0 last week to uphold a lower court’s dismissal of a 2013 lawsuit filed by the Equal Employment Opportunity Commission on behalf of Chastity Jones, a black woman.

Jones says that after she was offered a job in 2010 at a Mobile, Ala., insurance-claims-processing company, a white human resources manager told Jones that her locks violated company policy and that she’d have to get rid of them because they “tend to get messy.”

When Jones balked at changing her hairstyle, the job offer was rescinded.

The EEOC argued in its lawsuit that withdrawing the job offer because of Jones’ hairstyle constituted racial discrimination because “dreadlocks are a manner of wearing the hair that is physiologically and culturally associated with people of African descent.” But the federal court dismissed the case; the EEOC filed an appeal in 2015.

But the appeals court, in its Sept. 15 ruling upholding the lower court’s decision to dismiss the case, said that racial discrimination had to be based on characteristics that were unchangeable and that dreadlocks did not meet that definition.

“We recognize that the distinction between immutable and mutable characteristics of race can sometimes be a fine (and difficult) one, but it is a line that courts have drawn,”

U.S. Circuit Judge Adalberto Jordan wrote in the court’s ruling (pdf). “So, for example, discrimination on the basis of black hair texture (an immutable characteristic) is prohibited by Title VII, while adverse action on the basis of black hairstyle (a mutable choice) is not.”

A spokeswoman for the EEOC told the Wall Street Journal that the commission believes the court made the wrong decision.

“We believe the court was incorrect when it held that the employer’s actions could not be proven to be race discrimination,” she said. “We are reviewing our options.”

Chipotle Marketing Exec Indicted in Drug Ring Bust

The age-long rumor that Chipotle was sprinkling crack on the rice because it's so addictive may not be as funny anymore.

Sources have now reported that Mark Crumpacker, Chipotle's chief creative and development officer, has been indicted as part of a New York City drug ring bust.

(Mark) The Chipotle executive and Fox Business producer Katie Welnhofer were among 18 white collar buyers named as alleged "key repeat customers" who bought cocaine. They were charged with drug possession as well as criminal possession of a controlled substance, according to the Daily Mail.

The indictment comes after a yearlong investigation into cocaine trafficking around New York City's Lower East Side neighborhood. The drug ring allegedly sold over $75,000 worth of cocaine via a delivery service.

"This narcotics operation was organized and discreet, but it could not withstand the precision of this long-term investigation," said New York City Police Commissioner William Bratton.

A spokesperson from Chipotle says,

"At the moment, we know very little about these charges," the spokesman said. "Due to the nature of the situation, Mark has been placed on administrative leave. We made this decision in order to remain focused on the operation of our business and to allow Mark to focus on these personal matters. Mark's responsibilities have been assigned to other senior managers in his absence."

In Arrest Warrant Arrested Celeb Drama Celebrity News Kanye West kanye-west Legal Woes Mos Def New Music News Remix Say what?

Yasiin Bey’s Court Date In South Africa Delayed a Few Weeks

As reported back in January, Yasiin Bey, fka Mos Def, was arrested arrested abroad for travelling through South Africa with a “World Passport,” instead of US-issued travel document.

Yasiin appeared in court today outside of Cape Town to work out some legal details of his case however, he ran into a slight problem when the judge would not allow him to appear while wearing his turban. The emcee reportedly left and then chose to return with a scarf draped loosely around his head.

The proceeding went rather quickly, as the state called the hearing to request a postponement of the official court hearing while they finish their investigation into the matter.

Yasiin Bey’s lawyer, Shahied Schreuder, agreed to the postponement. The new court date has been set for March 24, only a few weeks away. Meanwhile, the rapper will continue to live in South Africa while out on bail.

Bey’s lawyer has been trying to soften the state’s impeding punishment for Yasiin Bey’s crime, saying that the Brooklyn emcee’s presence in the country has been beneficial to its arts industry.

“Many more international celebrities are looking at South Africa as a destination of choice for retirement and business,” said Schreuder. “We need to encourage that.”

In Big Freedia Celebrity News Legal Woes Say what?

Damn! Big Freedia Charged w/ Theft of Federal Funds

It was all good a few weeks ago for Big Freedia, the New Orleans Queen of Bounce, now has been charged with a felony count of theft of federal funds. Freedia, identified in court documents by her legal name of Freddie Ross, Jr., is accused of stealing more than $1,000 from the Department of Housing and Urban Development between 2010 and 2014.

If convicted she will be facing a maximum prison term of 10 years and fine of $250,000.

Freedia's attorney, Tim Kappel, said he is negotiating a plea deal with the government for Freedia to pay restitution of $34,000. He said he does not expect Freedia to serve any jail time.

In a statement, Freedia said she received federal housing vouchers for "many years" prior to rapidly gaining fame and "a new economic structure." Freedia said she "knew little about how to handle my money."

"It wasn't until recently (after I had stopped receiving housing vouchers) that it became very clear I had received assistance to which I wasn't entitled," Freedia said in the statement. "It was an oversight – but one that I take full responsibility for."

Kappel said Freedia previously offered to pay restitution, and to contribute to nonprofit organizations focused on tax preparation for low-income citizens and advocacy for LGBT youth, in a pre-trial diversion program.

"We made an offer that included restitution plus community service as part of a pre-trial diversion program," Kappel said, but the offer was "rejected by the government in favor of a felony count."

In BPP Legal Woes Mutulu Shakur News Say what? Shakur Tupac

2pac’s Stepfather Shares Legal Update on Denial of His Release

Tupac Shakur‘s stepfather, Mutulu Shakur, wrote a letter addressing the recent reports that he was scheduled to be released from prison as expected.

Last month, I was quick to report Mutulu was getting out of a California penitentiary early, but that buzz quickly died down once his son confirmed with VladTV that his father is “supposed to be out but he’s not out yet,” and they’re still “dealing with that shit now.”

Well in the open letter, Mutulu Shakur shed some insight as to why he thought he should have been released from prison on February 10 based on a law that releases inmates who’ve been sentenced to 45 years or more, but have served 30 years.

Mutulu Shakur writes:

Dear family and friends and supporters,

Like many of you, I was of the belief that I was to be released from prison, effective February 10, 2016. That belief was based on the 30 years I was required to serve. I have fulfilled that commitment while following all rules and regulations like any other prisoner would be expected to.

Having been sentenced under federal statute 4205(a), any person serving more than 45 years must serve 30 years to receive mandatory release.

For the past 30 years my target release date has been February 10, 2016. Whosoever had legitimate concerns had the same time to come forward to argue that I should not be released.

To deny me release at this stage the Parole Commission must determine that I have either “repeatedly or seriously violated the rules of the institution, or there exists a great probability that the inmate will commit any federal, state or local crime following his release.”

The Parole Commission’s function is now limited in scope. The idea is that the society as a whole is represented by the Parole Commission.

Hopefully the broader society has embraced a willingness to heal and move towards reconciliation. We have an obligation to ensure that the Parole Commission’s process is informed, fair, impartial and as unbiased as possible.

Many of the individuals that have opposed my release and question my resolve to be a productive member of society have had the benefit of mainstream media to project their views. I have endured the disadvantage of not having that benefit. My story has not been heard through the mass media. But I hope my call for reconciliation has been heard by some, and has had an impact, especially on young people.

What we have been tasked with is difficult and victory will have been hard fought. This is yet another stage of the struggle, but also an opportunity for our voices to be heard. I am hoping your messages can be shared with the Parole Commission as it makes a decision regarding my release or further incarceration.

Incarceration can be a catalyst to produce individuals that emerge with a newfound moral compass. I have been privileged to witness that growth and development in many other prisoners throughout my incarceration.

As a result, there have been many good works produced, both inside and outside of these walls.

I would not be who I am today without all of you and I can only hope to have been a positive influence in your lives and in the lives of young men who have been incarcerated with me.

It will be helpful to gather your thoughts and memories of our experience, and to share your sincere observations with the Parole Commission.

Please feel free to circulate this letter and my request to others who have had similar experiences that they would like to share.

My son Tupac acknowledged in the context of the struggle to overcome oppression that, “we’ve come so far, but still have so far to go …”

To that I say, we must continue to be guided by the essence of our circumstances that has brought us to these points; which encourage us to be principled, honest and continue to search for the truth.

Brotha Kendrick Lamar taught us “to pimp a butterfly.” From that we must always remember that we can evolve and to have faith in the power of transformation, that has been evident throughout the saga of our journey.

I thank you in advance for your continued love and support.

No-Twerkin' in Mississippi: Big Freedia's Performance Get Cancelled

Big Freedia, aka “Queen of Bounce,” and fresh off of her biggest mainstream exposure to date—That’s Freedia you hear talking about cornbread and collard greens on Beyoncé’s ”Formation" song"— well now she’s fighting with authorities in Mississippi over the freedom to drop down low and hit the floor with it.

The Guardian reported Freedia’s brush with local authorities in Hattiesburg, Mississippi, who shut down one of her shows earlier this month on the pretense that it violated a decades-old law prohibiting the intersection of lascivious shaking and hard liquor. (Her entourage of scantily-clad professional twerkers is a big part of Big Freedia’s act.)

According to Mississippi’s head of beverage control, “You can’t wear a thong ... And you cannot simulate a sex act“ at a venue that sells liquor in the so-called “Hospitality State,” although that doesn’t sound very hospitable at all. (The word “gyrating” was specifically invoked.)

And while Freedia’s performed in Hattiesburg before, the authorities were notified of this particular potential fun-code violation after watching videos of her on YouTube, having presumably only recently heard of her.

Following the cancellation of the show, Big Freedia posted on her Facebook page:
I would just like to apologize to all my fans in Mississippi for my show being cancelled tonight due to the state alcohol beverage control saying that my show violates some law out there when I have came numerous time to perform this is some twerkloose bulllshit and my team will be taking the necessary legal actions !! Once again I Love y'all Mtown stay strong fight for the Diva !! ‪#‎bigfreedia‬ ‪#‎mississippinonsense‬ ‪#‎twerkloose‬
Outraged fans along with other media outlets wanted to know why twerking is acceptable everywhere except the great state of Mississippi. Freedia’s manager also got in touch, and discovered that the burden of any fines levied for the performance would be borne by the venue, which also could lose its liquor license.

Ciara Slams Future with a $15 Million Lawsuit

It seems like singer, Ciara and rapper, Future are taking their beef to the judicial system!

Since calling off their engagement two years ago it seems they both can't stop throwing shots at each other. I must admit Ciara has been more subliminal about her shots, but Future has flat-out out said whatever was on his mind-- on social media and in his music.

However it looks like Ciara is so over Future's nonsense, she's reportedly filed a $15 million lawsuit against her son's father.

Legal documents confirms, Ciara points out a few interviews Future did where he spoke on her and Russell Wilson, including a radio show where Fewtch spoke on Russell walking baby Future in a stroller.
"She probably set him [Russell] up," he said at the time. "You letting them catch that photo. Leave my son out of all the publicity stunts."

She also references his January twitter rant where he said, "This bitch got control problems. I gotta go through lawyers to see babyfuture…the fuckery for 15k a month. I jus want babyfuture that's all."

Ciara mentions in the suit that she's gone out of her way to ensure Future spends time with his son, citing 19 visitations since December 2014, some spanning two-day periods.

She is suing him for slander and libel, would like all his mean tweets regarding her deleted, and she'd like to block him from speaking on private family matters regarding their son publicly again.

Mendeecees' Open Letter Before Turning Himself Into Prison

Mendeecees Harris (Husband of +VH1's Love & Hip Hop's Yandy Smith Harris) wrote a heart-felt post via his Instagram hours before turning himself into a Pennsylvania Penitentiary on Tuesday, January 19th to begin serving his 8-year bid for drug trafficking.

Mendeecees wrote:

“I know for some of you it feels like we’ve been here before, it’s the never ending story or some of you are probably so sick of hearing about me and this case that you completely tapped out and just don’t give a F#%k anymore, maybe never did (For you, stop reading now and please unfollow Asap). This message is for all those that have supported me, grew with me, changed hearts, minds and perspectives with me. When I was young, hungry and closed minded I acted as such. Now I’m wiser but it’s wisdom born through pain, so that means enduring this will just make me wiser and stronger. But who would have thought “Young DeeCee” that wore the ripped up worn shoes, that went to school on sugar sandwiches and borrowed rice would ever have a voice to speak to the masses. I was the one with nothing, no push to go to school, no dinner on the table at night, no kiss goodbye in the morning, all I had was me for awhile. Just Me, plane ole me ( I don’t have college degrees, a huge resume of internships and jobs) would be able to influence a generation. Who would have thought that my family would be a beacon of hope and love through out a community that’s so often taught family dysfunction, dissension and disloyalty. Men, step up! I’ve been there, where you are and I’ve learned in the end It truly is FAMILY OVER EVERYTHING! Fathers, go raise men! Men to lead their family. Men to do the right thing. No matter what you had to do or may still be doing raise them babies right! Also, when you raise a man you teach an individual but when you raise a woman you build a nation. Protect our nation builders fellas! I could go on for days but I want y’all to know I’m good [broken-heart emoji] but good. My family is strong, real strong, so their good. Keep @theharrisbunch in your prayers and I will keep you all updated through my brother running my page. In Arrest Warrant Arrested Celeb Drama Celebrity News Legal Woes Mos Def Prayers Say what? Yasiin Bey

Why Was Mos Def Arrested At South African Airport?

Sources are reporting that rapper/actor Mos Def, who now goes by the name Yasiin Bey, reportedly has 14 days to leave South Africa after he was arrested for violating local immigration laws while trying to leave the country, a government spokesman said Friday.

Mos Def,42 appeared in a South African court after he was arrested at Cape Town International Airport on Thursday after he produced an unrecognized “world passport” when he tried to leave the country.

It is rumored that he entered the country on an American passport in 2013 and overstayed his visitor’s permit by 2014. A court order to leave the country means the rapper is banned from South Africa for five years, but may appeal to officials for leniency.

Mos Def appeared alongside family members who were also in the country without a permit.

In Divorce Kardashian Legal Woes Marriage Rico Hines Say what? SideChicVsMainChic Tichina Arnold

Tichina Arnold's Husband Gets Caught Up with Sex Tape Scandal

Pam ain't having it... rumors are flying around that she popped off on her now-husband Rico Hines after discovering a sex-tape he had with one of his whores friends. Not only did he step out on their marriage he didn't even bother to wear a condom during his tryst.

TMZ reported, Tichina Arnold, hit the nuclear button on her 3-year marriage by exposing what she says is her husband's sex tape with another woman.

Sources very close to Tichina tell us she put Rico Hines on blast with a scathing group text to friends and family, saying ... "It's over between Rico and I. This is where I part ways and all bets are off." That's the tame part.

The bombshell?

She claims he's been banging scores of women -- sometimes without protection -- and she has a sex tape to prove it. Her mass text includes the video and she said, "I can't for the life of me understand why Rico would video himself f---ing 'raw dog' ONE of his MANY extraneous whores that 'trick' on him for his money."

Hines is an assistant basketball coach at St. John's University.

She also named 20 of the women, who she labels "extraneous Kim Kardashian wanna be's."

Tichina says she's concerned about STDs and plans to get tested. Her rep told People she's ending the marriage. It's unclear if she's filed divorce docs yet.

Hines tells us through a rep, "This is a private and deeply personal matter between my wife and me, and I do not want to comment any further at this time."

But he laughed and chatted with his attorneys.

When the judge said, “Mr. Cosby, good luck to you, sir," he shouted: "Thank you!"

50 Cent Files $2 Million Lawsuit Against Rick Ross

photo image: TMZ
50 Cent has filed a  $2 million lawsuit just days before Christmas against Rick Ross.

In Rozay's recent #RenzelRemixes mixtape you can hear him for rapping over 50's "In Da Club" beat. According to Billboard and 50 Cent's publicist, the Queens rapper's attorneys say they are working to preserve their client's reputation.
"50 Cent's most valuable asset is the name and reputation he has painstakingly built through his Grammy-winning music, acting, and business endeavors," said Paul LiCalsi, partner and co-chair of the Entertainment and Media Litigation Group at Robins Kaplan LLP. "He chooses his projects carefully for the very purpose of protecting that name and reputation."

"Our complaint alleges that Rick Ross has taken these without permission to advertise his own album, and violated 50 Cent's rights in the process, and we believe he should be held liable," LiCalsi notes of the suit, first reported by TMZ.
Craig Weiner, partner at Robins Kaplan LLP, adds, "We will use every legal tool available to remedy what we allege is an unauthorized use of 50 Cent's name, identity, and trademark. 50 Cent actively and generously collaborates with fellow hip-hop artists, but we maintain that this is a case of outright misappropriation. 50 Cent had absolutely nothing to do with Black Market or the mixtape that preceded it."

Earlier this year, the rappers fired shots at each other on Instagram when Ross mentioned 50's son, who applied to be an intern at MMG. If he wins 50 Cent stands to receive an estimate $2 million in this lawsuit.

#ShhhJustGotReal: Rita Ora Files Suit Against Roc Nation

Rita Ora just pissed Jay-Z off!

Rita has had it with Jay-Z and the Roc Nation Team by claiming that she was left in the dust when the company started representing pro-athletes. However, rumors report that it may be due to Rihanna and their alleged feud.

TMZ reported that the legal documents were filed Thursday (12/17) in Los Angeles, CA and Rita says the change of direction at Roc Nation led to a revolving door of executives, and eventually there was no one left who had worked with her.

Rita says Roc Nation's only released one album for her since she signed in 2008, but says she's sitting on a bunch more music that the label hasn't released.

She says her deal could keep her in Roc's stable until 2019 or later -- but she wants out now, and says there's legal precedent in CA for her release to be granted.

Following the sentence Harris’ attorney Donald Thompson told Billboard,
“The possibility of a jail sentence has been well known in the community, and he's talked about that with kids who are coming up in difficult situations and have to make life choices, whether it's a good idea to make a whole lot of money selling drugs or make less money and not have to be looking over your shoulder."
For his part, Harris took full responsibility for his actions with a thoughful message to his fans shared via Instagram:

I want you all to understand something. I completely accept responsibility for all that is going on. My transition to be a better person a productive person started well before this case. However in my past I made some bad decisions. Young men let my life be an example to you now before it's too late. Better who you are now in your children's lives and in society so you can change the path of your fate. Lack of opportunities, a fatherless home, the unforgiven neighborhood and circumstances you grew up in can no longer be your excuse. Trust me I tried. And it doesn't make the pain your family feels any different. Young man educate your self and break the cycle. Don't become a number on the DOA (dead on arrival) list or on the incarceration list. To my wife and children you are all strong and well prepared for this. This is just another brick laid down towards our house of happily ever after , walk with your head held high knowing I would never past the buck and put another family through what we have endured. Continue to walk in faith and love as you've done so well. To my peoples thank you for all the encouragement and support please continue to encourage my family. Thank you again all.

2 Chainz Wins Lawsuit For Calling a Chic a Thot on Video

Back in July if you recall I posted the story of the THOT sueing 2-Chainz for Being Called a THOT on Video...well, that's over!

TMZ reports this morning that a North Carolina judge has tossed out the Christine Chisholm's lawsuit entirely, aka the “THOT” woman. In his ruling, the judge said calling someone a "THOT" does not rise to the level of "extreme or outrageous conduct."

Rumors started circulating last week that, Christine made several wild accusations that 2 Chainz was also attempting to put out a hit on her, from reportedly having cars follow her to what she thinks are “direct” lyrics in his latest song “Watch Out.”

With all that said, it’s pretty clear Christine was trying to get +2 Chainz in some serious trouble with the law & with his pockets, but neither of which will be the case rightfully so.
